Can a will be notarized online in Florida?

Yes. Florida has recognized electronic wills since 2020. The will is signed in a live audio-video session with two witnesses and a notary, the same procedure Florida requires for a paper will. Electronic wills carry an additional storage rule: to remain self-proving, the signed electronic will must stay in the custody of a qualified custodian. Witnesses join the video call

Florida wills require two witnesses. In an online session, your witnesses do not have to be in the room with you. Florida law (F.S. 117.285) allows them to join the video call remotely, as long as each witness is a resident of and physically located within the United States or a U.S. territory (F.S. 117.285(4)). You provide your own witnesses, and choosing them carefully matters: witnesses who are not relatives, beneficiaries, or otherwise named in the document avoid questions about the signing later. Online witnessing and vulnerable adults

Florida's online notarization law (F.S. 117.201-117.305) adds a safeguard to five kinds of documents: a will, a trust with testamentary aspects, a health care advance directive, a waiver of spousal rights, and a power of attorney that authorizes any of those. For these documents, if the signer is a vulnerable adult as Florida defines it, remote witnessing is not permitted. That rule comes from the statute, not from any one company: no online notary, on any platform, can complete that signing with witnesses on video. The witnesses must be physically present with the signer. A vulnerable adult is a person 18 or older whose ability to perform the activities of daily living, or to provide for his or her own care or protection, is impaired by disability, brain injury, or the infirmities of aging. Activities of daily living are everyday self-care tasks such as walking, bathing, dressing, eating, grooming, and using the toilet. The notary asks a short set of required questions at the start of every online session to confirm remote witnessing is available.
